TERMS AND CONDITIONS

This website is operated and run by the Committee of Soundwaves Community Choir for the use of its members and friends of the choir.
Definition of terms used in this document:
In these terms and conditions, “we” “us” and “our” refers to Sound Waves Community Choir and the service we provide, the Service.  Your access to and use of all information (“Content”) on this website is provided subject to these terms and conditions. 
‘Event’ is a set of rehearsal sessions which may or may not lead to a performance.
For the purposes of management of the choir and website, anyone singing with the choir is allocated a membership status as follows:
‘Regular member’ refers to both ‘current’ and ‘archived’ members, i.e. any individual who has completed a membership form. (These individuals are referred to as registered members in the Constitution of the choir.)
‘Prospective member’ is a new member and/or an individual who has not completed a membership form.
We reserve the right to amend this Notice at any time and your use of this website following any amendments will represent your agreement to be bound by these terms and conditions as amended.  We will inform current members of any changes to these Terms and Conditions by email.  The date of any updates will be indicated at the top of the page.
 
Registration
1              You must complete registration by providing full information as set out on our registration page.  Please also refer to our Privacy Policy, available in the Society Documents, for information relating to our collection, storage and use of the details you provide on registration.
2              Upon registration on the website you will be referred to as a ‘temporary member’ and informed by email of your registration acceptance. Registration on the website will allow you to enrol in any of our available events. Having successfully registered for an event you will be able to access music and downloads necessary to learn the repertoire of songs in that event. 
3              Priority in allocation of places in an event is always given to current members of the choir, if they register for the event in the time allotted.  For all other members, allocation is on a ‘first come, first served’ basis.
4              You agree to ensure that your registration details, including your name and email address, are true and accurate at all times and you undertake to inform the Committee of any changes to your registration details using the address admin@soundwaveschoir.org.
5              We reserve the right to terminate your membership at any time if you breach these terms and conditions.
6              You may terminate your membership at any time.
 
Full Membership of the choir
1          Full membership of the choir is free with current membership being on an annual basis.  Please read the Sound Waves Choir Constitution for further details on membership.
2          Temporary members can become full members of the choir by
a)   paying for one complete event with a Musical Director and
b)   completing a membership form. 
They will then be referred to as ‘current members’.  A membership form is available to download from the Society Documents section of the website., It should be completed and returned to the Membership Secretary through admin@soundwaveschoir.co.uk  putting ‘Membership’ in the subject line or handed directly to the Membership Secretary.
3          Current membership must be renewed annually in one of the following ways
      a)    By attending the AGM or sending apologies for non-attendance.
      b)    Expressing, in writing (including emails) to the committee, a wish to continue membership before the date of the AGM in any given year.
In both cases, the member should have sung with the choir during the previous choir year.
4          Current members whose annual membership has lapsed can rejoin the choir at any time by registering and paying for one complete event.  Lapsed full members are termed as ‘archived members’ by the choir administration. 
5          If any singers have not sung with the choir in the past 18 months, they will be termed as ‘non-members’ and will have to contact the Membership Secretary to re-activate their account.  If anyone registered on the website has not sung with the choir for two years their personal details are removed from the website and any other records held by the Membership Secretary. This is to ensure data protection for those individuals and to keep the database current for administration purposes.

Payment of fees
1                     For new members only the first week of rehearsal sessions is a taster session and is free.
2                     If you decide to continue with the sessions, a fee for the remaining sessions is due on the second week.  NOTE:  If for any reason, you are unable to attend for one or more weeks, you are still liable for full payment of the remaining sessions as the choir is still liable for payments for musical directors, venue hire and preparation of music. 
3                     Unfortunately, it is not possible to give refunds, for the reasons stated above, to anyone who does not complete the full set of rehearsals.
4                     Payment can be made upon registering for the total cost or two instalments
5                     We have two methods of payment available:
a.       By BACS
b.       By cheque made payable to Sound Waves Community Choir and handed in at one of the sessions in the first two weeks.
6                     Other options are available for those who are experiencing financial difficulties and, in this case, contact should be made directly with the Treasurer at treasurer@soundwaveschoir.co.uk .

2.             You may link our website without our consent.  Any such linking will be entirely your responsibility and at your expense.  By linking, you must not alter any of our website's contents including any intellectual property notices and you must not frame or reformat any of our pages, files, images, text or other materials.
Disclaimers, Limitation of Liability and Indemnity
 1.      Whilst we take all due care in providing our services, we do not provide any warranty either express or implied including without limitation warranties fitness for a  particular purpose.
2.             To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded. 
3.             We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.
4.             To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the Service again or payment of the costs of having those services supplied again.
5.             We accept no liability for any loss whatsoever including consequential loss suffered by you arising from services we have supplied.
6.             By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website. 
Jurisdiction
7.             These terms and conditions are to be governed by and construed in accordance with the laws of England and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in England and you agree to submit to the jurisdiction of those Courts.
8.             If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity.  If necessary, the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
Privacy
9.             We undertake to take all due care with any information which you may provide to us when accessing our website. However, we do not warrant and cannot ensure the security of any information which you may provide to us.  Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
10.        Our compliance with privacy legislation is set out in our separate Privacy Policy which may be accessed from our home page.
